IMPORTANT! Following are the terms you agree to when you utilize our services. Please check back from time to time as we reserve the right to update these terms at any time.

BILLING POLICY

Account Setup: All new hosting accounts are manually verified to prevent fraud. We have the right to refuse, cancel or suspend service at our sole discretion. If your hosting order is accepted we will send you your welcome information within 24 hours of placing your order.

Recurring Charge: From the date you placed your order your credit card will be charged recurringly depending on what billing schedule you chose (monthly, quarterly, semi-annually, annually). For example: If you chose to pay monthly and you ordered your account on the 15th of December, you would next be billed on January 15th. Recurring charges will continue until you cancel your hosting account.

Delinquent Accounts: If your credit card is declined you will receive a notice via email letting you know you need to update your billing information. If you do not update your information by the deadline your website will be suspended. After that, as soon as you update your credit card information your site will be reactivated automatically by our billing software. If you do not update your information your site will be deleted off Spooky's server in 30 days.

Billing Updates: Clients can update their credit card, address and email address at any time in the client area of our site.

Cancellation: Clients can cancel their webhosting account(s) at any time by submitting a support ticket.

ACCEPTABLE USE POLICY

By using our services you agree to our Acceptable Use Policy which is found here. Violations will result in account termination.

BACKUP POLICY

Full backups are made nightly but to be safe you should always maintain local copies of your web content as their is no guarantee as to the integrity of these backups. There is a handy backup utility in your website's CPanel.

PRIVACY POLICY

We do not share your personal information with any other company. However to fight fraudulent orders we collect information from you so that we can determine the validity of your order (such as your IP Address).

IF the order placed is fraudulent we reserve the right to share this information that we collected from you with the actual credit card owner, the issuing bank and law agencies. WE DO NOT TAKE FRAUD LIGHTLY.

We may add a link to your site on spookymedia.com to feature some of our favorite hostees, but if you would rather your site not be included you can email us and we'll pull it.

You are responsible for maintaining the confidentiality of your password. Be sure to change your password every so often - and make it hard to guess! Also be careful who you share it with as you are responsible for all the uses of your account, whether or not you allowed it.

IDEMNIFICATION POLICY

In no event shall Spooky Media be liable to you or any third party for any special, punitive, incidental, indirect or consequential damages of any kind. You agree that you shall defend, indemnify, save and hold Spooky Media harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Spooky Media or it's customers, that may arise or result from any service provided or performed or agreed to be performed or any product sold.

Spooky Media shall be the sole judge of what violates this policy.
